Legaltech: L’innovation technologique dans le monde juridique

La technologie a envahi la majorité des secteurs d’activité au cours des dernières décennies. Le secteur juridique – traditionnel, méticuleux, vigilant et fortement basé sur le jugement humain – tardait toutefois à accepter ces changements. Ce n’est que depuis ces quelques dernières années que les investissements dans les entreprises de ce qu’on appelle legaltech ont commencé à croître.

Comme son nom l’indique, la  legaltech , dérivée de l’expression anglaise « Legal Technology » qui signifie technologie juridique, se rapporte à l’automatisation des services juridiques, c’est-à-dire à l’offre de services juridiques avec le support de nouvelles technologies et logiciels.

La legaltech est apparue comme une start-up juridique en ligne aux États-Unis, s’adressant aussi bien aux professionnels du droit qu’aux particuliers, sur plusieurs niveaux.

Il existe différents types de legaltech, offrant divers services. Pour les professionnels du droit, la legaltech propose des services tels que le stockage et la génération de documents juridiques, l’automatisation de la rédaction juridique, la facturation, les procédures judiciaires, des modèles de documents juridiques, etc. Pour les clients, la legaltech aide ceux-ci à se mettre en contact avec des avocats. Elle leur permet également de connaître les tarifs, car l’une des caractéristiques les plus importantes de la legaltech est la transparence, en particulier du fait que, de nos jours, les clients exigent des prix préétablis qui ne changent pas en fonction du temps consacré à leur dossier.

Cependant, de nombreux cabinets restent sceptiques par rapport à la legaltech, et peuvent même considérer celle-ci comme une menace pour le secteur juridique traditionnel constitué d’avocats, de juristes, de secrétaires, de notaires…etc et de leurs compétences professionnelles.

Pourtant la legaltech ne se substitue pas à ces derniers. Au contraire, elle permet de faire gagner du temps et de simplifier le travail des professionnels droit, en les libérant des tâches basiques et des formalités quotidiennes et répétitives, et leur permet de concentrer leurs efforts sur les parties importantes de leur travail, leur offrant ainsi une flexibilité et une productivité accrue.

Le succès de la legaltech reste toutefois fortement lié au soutien financier du gouvernement et à l’accessibilité numérique de la population, permettant ainsi de dynamiser le marché modernisé du droit.

Legaltech: The technological innovation in the legal world

In The past few decades, technology has invaded the majority of business sectors. The legal sector – traditional, meticulous, vigilant and highly based on human judgment- was however relatively late in embracing these changes. It is only in recent years that investment in legaltech companies started to grow.

As its name suggests, legaltech is derived from Legal Technology, and relates to the automation of legal services, i.e., offering legal services with the support of new technologies and softwares.

Having emerged in the United States, legaltech  started as  an online law startup that serves both law professionals and individuals on many levels of the legal field.

There are different types of legaltechs, offering various services. For law professionals, legaltechs offers services like the storage and generation of legal documents, the automation of legal drafting, sample legal documents, billing, legal process …etc. For the clients on the other hand, legaltech helps to put them in contact with lawyers. It also allows them to know the tariffs, since one of the most important characteristics of legaltech is transparency, especially that nowadays customers want pre-established prices that do not change according to the time spent on their cases.

Many firms remain skeptical about the legaltech, and may even consider it a threat to the traditional legal sector consisting of lawyers, lawyers, secretaries, notaries … etc. Yet the legaltech is not a substitute for the latter.  On the contrary, legaltech discharges law professionals from daily basic tasks and formalities, and allows them to focus their efforts on the important parts of their work, thus granting them flexibility and increasing their productivity.

Nevertheless, the success of the legaltech remains strongly linked to the financial support of the government and the digital accessibility of the population, thereby boosting the modernized market law.

 كان الهدف من الإصلاح الذي بدأ سنة 2016 هو تحديث القانون الأوروبي وجعله قابلاً للتكيف مع احتياجات العصر من خلال خلق توازن بين أصحاب  حقوق المؤلف  ومنصات الخدمات على الإنترنت ، خاصة  منها المنصات الكبرى التي تتحكم في السوق الرقمية (GAFAM ) ، وذلك عبر إلزام هذه المنصات بالحد من نشر المحتوى المحمي بحقوق المؤلف.

فإلى حد الآن ، لم تكن المنصات مسؤولة عن انتهاك حقوق المؤلف ، وكانت مسؤوليتها تقتصر على إزالة المحتوى المحمي بموجب هذه الحقوق بناءً على طلب أصحابها.

و من الملاحظ أن الفصلان 17 و 15 (الفصلان 11و 13 سابقا) من التوجيه كانا موضع جدلا كبيرا.

 حيث أن الفصل 15 (الفصل 11 سابقا) يضبط الحقوق المجاورة لحقوق المؤلف من أجل إجبار المنصات الرقمية الرئيسية مثل Google News على تقديم تعويض مالي لوسائل الإعلام عند استخدامها لمحتوي نشراتهم. كما انه بموجب الفصل 17 من التوجيه الجديد (الفصل 13 سابقا)  ، أصبحت هذه المنصات ملزمة بتصفية المحتوى المحمي بحقوق المؤلف بصفة تلقائيًة ، وأصبحت تعتبر مسؤولة في حالة انتهاك هذه الحقوق.

في خضم هذا الجدل برز موقفان رئيسيان عبر عنهما مختلف الأطراف الفاعلة في الشبكة. فمن جهة يعتبر المؤيدون لحماية حقوق المؤلف أن محتوى التوجه الجيد يتيح مكافأة أفضل للفنانين و الصحفيين الناشرين من النشاط الناتج عن نشر و تداول المحتوى الخاص بهم على منصات الإنترنت . و في المقابل ، يعارض دعاة النشر الحر على الإنترنت فكرة إلزامية الرقابة و إضفاء الطابع المؤسساتي في تنظيمها بحجة إمكانية التجاوزات التي يمكن أن يؤدي إليها  هذا النوع من الرقابة التلقائية.

It is the articles 17 and 15, respectively former articles 11 and 13 of the directive, that sparked a huge controversy.

Article 15 (former article 11) establishes neighboring rights of copyright for press publishers in order to oblige major digital platforms like Google News to remunerate the media when they use their content.

Until now, platforms were not reponsible for copyright violation, and their responsibility was limited to removing the copyrighted content on the request of the copyright holders. With the article 17 (former article 13) of the new copyright directive, these platforms became under the obligation of automatically filtering copyrighted content, and became liable in case of copyrigh infringement.

There are two main position undertaken by the different players in the net:

Those who were on the right holders’ side and in favor of the directive, concider that the latter allows a  better remuneration for artists and press publishers from the traffic generated by their content on platforms.

On the other side, the advocates of free diffusion on the internet dispute the idea of ​​a binding regulation and the excesses it could lead to, esspecially the institutionalization of automatic censorship.
